STANDARD TERMS OF MEMBERSHIP
1. In these Standard Terms of Membership:-“TTTA” means Townsville Table Tennis Association Inc “TTTA Group” means TTTA and its respective administrators, directors, agents, officers, officials, committee members, volunteers, employees, other participants, any sponsors, advertisers and if applicable, owners and lessors of premises on which the sport takes.“you” or “your” means the member named in this membership application form and wherever relevant, includes such members minor child, personal representatives, assigns, heirs, and next of kin.
2. You understand that by being a TTTA member and/or entering the fixture season at TTTA you will operate under the bylaws and policies of TTTA and Table Tennis Queensland (TTQ) that you are committing yourself to play the entire season or to have arranged suitable substitute player/s for any scheduled absence. You understand and accept that the Committee of the TTTA can place you into any division of the competition and that by entering the competition you’re committing yourself to play that division for the entire fixture season. You understand that to play fixtures at the TTTA you must be a current club/tournament registered member of TTQ and have primary registration with TTTA. You understand that TTTA is a family friendly environment with the consequence that a very high standard of behaviour is required.
3. You understand the nature of table tennis activities and are aware that participating in a sport such as table tennis is potentially hazardous activity and contains risks. These risks may be caused by you and/or your minor child’s own actions or inaction, or the actions or inaction of others participating in the sport. There may also be other risks and social and economic losses either not known to you or not readily foreseeable at this time and you fully accept and assume all such risks and all responsibility for losses, costs and damages you incur as a result of my participation in the sport.
4. You acknowledge, agree, represent and warrant that in consideration of your membership being accepted by TTTA and being permitted to participate in the sport, you hereby willingly assume all risks associated with participating in the sport including, but not limited to, falls, contact with other members, injuries that might arise from the use of the table tennis equipment or our club hall, all such risks being known to you and appreciated by you.
5. You acknowledge that you are in good health and in proper physical condition to participate in the sport and that it is your responsibility to consult with my medical practitioner prior to participating in the sport to ensure that your participation will not pose any unusual risk to your health and wellbeing. You further agree that if at any time you believe conditions or equipment to be unsafe, you will immediately discontinue further participation in the sport.
6. Having read this agreement and knowing these facts, and in consideration of TTTA’s acceptance of your membership and permitting in you to participate in the sport, you for yourself and anyone entitled to participate in the sport on your behalf:-
a. waive and release the TTTA Group from all claims (including future claims), demands, losses, damages and liabilities of any kind known or unknown, arising out of your use of and participation in the sport and the facilities contained in the TTTA premises, including, but not limited to, claims for damages for personal injury and/or property damage, even though such liability or claim may arise out of the negligence or fault on the part of the TTTA Group; and
b. indemnify (and agree to keep indemnified) the TTTA Group from and against any action, claim or other proceedings whatsoever bought against or incurred by TTTA (including legal costs on an indemnity basis) and including but not limited to any claim to any property real or personal or any claim in respect of injury to or death of any person and any losses, damages, liabilities or damages arising out of or in connection with any failure by you to perform or comply with any of the terms and conditions herein contained, any breach of any warranty by you as is herein contained, or any negligent or wilful acts or omissions by you.
